GENERAL TERMS AND CONDITIONS OF ONLINE SALES VIA THE ORC OF VILLA HERISSON
1. Purpose
These general terms and conditions apply to all online bookings made with our establishment Villa Herisson through the Regional Commercialisation Tool (ORC).
The customer acknowledges having read and accepted these general terms and conditions. No booking can be made without the customer's agreement to these terms and conditions. The customer has the option to save and print these general terms and conditions.
2. Offers
All our advertisements, web pages and offers are prepared in good faith and based on the information available. Maps, photographs and illustrations are provided for information purposes only and are not contractually binding. They may be modified before the booking is finalized. The customer authorizes us to correct any obvious material errors in the information communicated.
3. Prices
The prices displayed at the time of booking constitute the total price of the service sold, including taxes, fees and other charges. Any additional charges are clearly indicated before the booking is confirmed.
The customer authorizes us to correct any obvious pricing errors.
4. Booking
The customer selects the services presented on the regional commercialisation tool. The customer acknowledges having read the nature, destination and booking terms of the services available on the booking tool and having requested and obtained all necessary and/or additional information in order to make the booking with full knowledge of the facts. The customer is solely responsible for their choice of services and their suitability for their needs, so our liability cannot be engaged in this respect. The booking is deemed accepted by the customer at the end of the booking process.
5. Booking process
Bookings made by the customer are carried out through the dematerialized booking form accessible online on the booking tool. The booking is deemed concluded upon receipt of the booking form. Prior to any booking, the customer undertakes to complete all information necessary for the booking. The customer certifies the truthfulness and accuracy of the information provided. Once the final choice of services to be booked has been made, the booking procedure includes the following steps until validation:
entering bank card details in the event of a guarantee or prepayment request, consultation and acceptance of the general terms and conditions of sale relating to the service(s), and finally, validation of the booking by the customer.
6. Acknowledgement of receipt of booking
The booking tool acknowledges receipt of the customer's booking and confirms it without delay by sending an email. The booking confirmation email summarizes the contract offer, the booked services, the prices, the terms and conditions of sale related to the selected rate accepted by the customer, the booking date, and the address of the establishment where the customer may submit complaints.
7. Right of withdrawal
It is recalled that, in accordance with Article VI.53 of the Belgian Code of Economic Law, if the contract provides for a specific date or period of performance, the customer does not have the right of withdrawal in the case of booking:
accommodation other than for residential purposes (for example, holiday accommodation), transport, car rental, catering and services related to leisure activities.
8. Privacy protection
We collect your data in accordance with the General Data Protection Regulation (2016/679) (""GDPR"").
The personal data you provide us with are necessary for processing your booking and are essential for the management and provision of services (Article 6.1.b of the aforementioned Regulation). For these purposes, your data may be transferred to our partners, including Elloha.com which manages the booking tool, online payment providers, and service providers established in third countries. In particular, during online payment, the customer's banking details must be transmitted by the payment provider to the establishment's bank for the execution of the booking contract. We only use partners guaranteeing a level of protection compliant with the principles set out in the GDPR.
With your consent, your data may also be used by us to send you promotional or commercial offers by email.
We retain your data for a period of 3 years after the last contact (email, booking, etc.).
As a person whose data is collected, you have the right to access, rectify and erase your data, as well as the right to object to the collection of your data. These rights may be exercised by sending us an email mentioning your surname, first name, address and the subject of your request.
Complaints relating to the collection and processing of your personal data may be addressed to the competent supervisory authority.
